Civic budget in local government units as a specific type of local referendum

Abstract

This study is an attempt to answer the question about the character and position and the importance of the civic budget procedure in the context of the principles defining the system of local government units in Poland. Is the civic budget procedure a special kind of public consultation or should it be included, as a specific kind of local referenda, in the regulations relating directly to this form of direct democracy?

The conclusion of the study is that the civic budget, which shows the features of referendum decisions, should ultimately bein the catalog of tools provided for in the Local Referendum Act - of course taking into account its specific nature. This placement of the civic budget is supported primarily by the result of voting by the inhabitants, binding on local government units.
